Terms of Service

These are the terms you agree to when you use NoNap. Section 5 covers physical wake tasks, section 7 covers alarm reliability and section 9 covers subscriptions and how to cancel. Please read all three.

1Agreement to these terms

NoNap is an alarm app for iPhone published by Visana Studios (“we”, “us”, “our”). By downloading, installing or using NoNap (the “App”), you agree to these Terms of Service (the “Terms”). If you do not agree with them, do not use the App.

These Terms are a binding agreement between you and us. We may update them from time to time; the current version is always the one published on this page, with the date shown at the top. If a change is significant we will make it visible in the App or on this site. Continuing to use the App after a change takes effect means you accept the updated Terms.

2Who can use NoNap

You must be at least 16 years old to use NoNap in the European Economic Area and the United Kingdom, or at least 13 years old elsewhere. If you are under 18, you confirm that a parent or legal guardian has read these Terms and agreed to them on your behalf.

NoNap includes wake tasks that require physical effort. You should only use those tasks if you are physically able to perform them safely. See section 5.

3Your licence to use the app

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use NoNap on a device you own or control, for your own personal, non-commercial use. We keep every right we do not expressly grant you here.

You may not:

  • Copy, modify, translate or distribute the App or any part of it
  • Reverse engineer, decompile or disassemble the App, except to the extent that applicable law expressly permits it despite this restriction
  • Rent, lease, lend, sell, sublicense or otherwise transfer the App to anyone else
  • Remove or obscure any copyright, trademark or other proprietary notice in the App
  • Use the App for any unlawful purpose, or in any way that interferes with its normal operation

4No account, no sign-up

NoNap does not have user accounts. There is nothing to register for, no username or password, and no profile. You download the App, set an alarm, and use it. Because there is no account, there is also nothing for us to suspend or delete. If you want to stop using NoNap, delete the App from your device.

Deleting the App removes the data it stored on your device, including your alarms, settings, wake-up history and streaks. That deletion is permanent and we cannot restore it, because we never had a copy. See section 8.

5Physical activity, you take part at your own risk

Please read this section carefully

NoNap asks you to move your body, first thing in the morning, while you are still waking up. That carries real risk of injury. You choose to do it, and you do it at your own risk.

To turn off a NoNap alarm you complete a wake task that you chose in advance. Several of those tasks are physical: Push-Ups, Squats, Dance, 67, Steps, Distance (walking a set distance, measured by GPS) and Shake Phone. The Photo and Object tasks ask you to get up and point the camera at something. The Math task is the only one that requires no physical movement at all.

By using the App you acknowledge and agree that:

  • Talk to a doctor first. Consult a physician before starting any exercise routine, and especially if you have a heart condition, high or low blood pressure, a joint or back problem, a previous injury, a disability, dizziness or balance issues, or if you are pregnant or recovering from surgery or illness.
  • Physical activity can hurt you. Push-ups, squats, dancing, body-position movements, shaking your phone, walking a distance and other movement can cause muscle strain, joint or back injury, falls, collisions with furniture, walls, stairs or other people, and damage to your phone or your surroundings.
  • You are waking up, which makes it riskier. Sleep inertia impairs coordination, balance and judgement. Movement that is safe for you at midday may not be safe for you thirty seconds after an alarm.
  • Choose tasks and targets you can safely complete. Do not set a repetition, step or difficulty target that you cannot finish safely on a bad morning. You can change your wake task at any time.
  • Check your surroundings before you move. Make sure you have clear space around you, away from stairs, glass, sharp edges, hot surfaces, other people and pets, before performing any physical task.
  • Never look at your phone instead of where you are going. The Steps, Distance and camera tasks can involve walking around, and the Distance task may take you outdoors. Watch for traffic, roads, cyclists, kerbs, stairs, water and uneven ground, and never perform a wake task while driving, cycling or operating anything. Follow the law wherever you are. You are responsible for choosing a safe place and a safe time to complete a task.
  • Stop immediately if something hurts. If you feel pain, dizziness, shortness of breath, chest discomfort or any other warning sign, stop, and seek medical help if needed. Do not push through it to switch off an alarm.
  • Do not use the App while impaired. Do not perform physical wake tasks while intoxicated, medicated in a way that affects coordination, injured, or otherwise impaired.
  • NoNap is not medical or fitness advice. Nothing in the App is medical advice, a diagnosis, a treatment plan or a training programme, and nothing in it is a substitute for professional evaluation. Repetition counts, streaks, wake-up charts and any other statistics the App shows are for general information only.

Our responsibility

You perform physical wake tasks at your own risk. To the fullest extent permitted by applicable law, we are not liable for any injury, health consequence, property damage or other loss arising from physical activity you perform in connection with the App, from your choice of wake task or target, or from the environment you chose to perform it in.

Nothing in these Terms excludes or limits our liability where the law does not allow it to be excluded, in particular for death or personal injury caused by our negligence, for fraud, or for intent or gross negligence on our part. Your mandatory rights as a consumer are unaffected. See section 14.

6Wake tasks and how they are verified

Different wake tasks are checked in different ways. All of them are checked on your device.

Camera-verified movement tasks

Push-Ups, Squats, Dance and 67 are verified by movement based on detected body position. With your permission, the App uses your device's camera and on-device machine learning to recognise your body position in real time and count the movement.

  • No video or photo is recorded. The camera feed is analysed live on your device and discarded frame by frame. Nothing is saved to your photo library, written to storage, uploaded, or transmitted to us or to anyone else.
  • It runs entirely on your device. The App does not need an internet connection to verify a movement task.
  • It is not facial recognition. Detection reads body position to count movement. It is not used to identify you, and no face template or other biometric identifier is created, stored or shared.
  • You can revoke camera access at any time in iOS Settings. Doing so disables the camera-verified tasks; the other tasks keep working.

Camera-verified object tasks

The Photo and Object tasks ask you to point the camera at something (a made bed, a sink, a specific object you set in advance) and on-device object detection checks whether it is in frame. The same rules apply: the camera feed is analysed live on your device, nothing is recorded, saved or uploaded, and whatever else happens to be in the frame is never stored. Point the camera at your own surroundings, and see section 10 about other people.

Steps, Distance and Shake Phone

The Steps and Shake Phone tasks use your device's motion sensors, on the device. The Distance task asks you to walk a set distance and measures it using your device's GPS and location services, with your permission and only while the task is running. Your location is used on the device to work out how far you have moved and is not sent to us. We have no servers that could receive it. These tasks require you to physically move, so please read the warnings in section 5, especially about stairs, traffic and going outdoors.

GPS accuracy varies. Buildings, tunnels, weather, indoor use and iOS location settings all affect it, so a measured distance may not match the real one, and the task may take longer or shorter than expected to register as complete.

Math

The Math task asks you to solve a problem to dismiss the alarm. It involves no camera, no location, no microphone and no physical movement.

Detection is not perfect

Body-position detection, object detection, step counting and GPS distance are automated and can be wrong. Lighting, camera angle, clothing, distance from the device, how you carry your phone, GPS signal and many other factors affect them. We do not warrant that every repetition, object, step or metre will be counted, that a task will always be recognised as complete, or that verification cannot be worked around. If a task is not being recognised, switch to a different task rather than forcing the movement.

7Alarm reliability, no guarantee that you will wake up

Always keep a backup alarm

NoNap is an aid, not a guaranteed wake-up service. Do not rely on it as your only means of waking for anything that matters: work, travel, exams, medication or appointments.

We do not warrant that an alarm will sound, vibrate, display or wake you at a particular time, or at all. Whether an alarm reaches you depends on things outside our control, including:

  • iOS behaviour, system updates and how iOS schedules and delivers alarms
  • The permissions you grant the App, and whether you later revoke them
  • Focus modes, Do Not Disturb, silent mode, volume level and connected audio devices
  • Battery level, Low Power Mode, and the device being switched off or out of battery
  • Background app refresh, Screen Time limits and other system restrictions
  • Device faults, storage problems, force-quitting the App, or deleting or changing an alarm

To the fullest extent permitted by law, we are not liable for a missed, delayed or silent alarm, or for oversleeping, missed appointments, missed transport, lost income or any other consequence of an alarm that did not wake you.

8Your data stays on your device

NoNap stores your data locally on your device. Your alarms, alarm times, chosen wake tasks, settings, wake-up history, streaks and statistics are kept on the device and are not uploaded to us. We do not collect, receive, store or have access to that data. We do not run an account system or a backend that holds it, we cannot see it, and we cannot recover it for you.

  • No sleep tracking. NoNap does not track your sleep. It does not read Apple Health data, it does not monitor you overnight, and it does not record audio or video while you sleep. The only times it records anything are the moments you are actively completing a camera-verified wake task, and even then, nothing is saved (see section 6).
  • No location tracking. NoNap only uses location while you are actually completing a Distance task, to measure how far you have walked. It does not track your location in the background, does not build a location history, and does not send your location to us or to anyone else (see section 6).
  • Backups are yours. If your device backs itself up to iCloud or to a computer, NoNap's local data may be included in that backup, under Apple's terms and your own settings. That is your device's backup, not ours.
  • Deleting the App deletes the data. Uninstalling NoNap removes its local data permanently. We have no copy and cannot restore it.
  • Losing your device means losing the data. Because nothing is stored on our side, a lost, reset or broken device means the history and streaks stored on it are gone.

Two things do leave your device: your App Store purchase record, which is described in the next section, and anonymous usage statistics and crash reports, which you can switch off in the App under Settings → Your data → Share anonymous usage data. Our Privacy Policy explains data handling in full.

9Purchases, subscriptions and how to cancel

NoNap is a paid app. You can try onboarding and set up your first alarm, and access to the alarm features is then unlocked with one of the plans shown in the App: an auto-renewing subscription (weekly, monthly or yearly) or a one-time lifetime purchase. The exact price for your country and currency is always shown in the App before you buy. There are no ads in NoNap.

Every purchase is made through Apple's App Store in-app purchase system, under the App Store terms. Apple processes the payment; we never see or store your card or payment details.

Auto-renewing subscriptions

  • Renewal. A subscription renews automatically at the end of each period (week, month or year) at the price shown when you bought it, unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within 24 hours before the current period ends.
  • Cancelling. You can cancel at any time in iOS Settings → your name → Subscriptions, or from the App under Settings → Manage purchases, which opens the same Apple subscription management. Cancelling stops the next renewal; you keep access until the end of the period you already paid for. Deleting the App does not cancel a subscription.
  • Price changes. If we change a subscription price, Apple will notify you in advance and, where the law requires it, ask for your consent before the new price applies.
  • Free trials. Some plans include a free trial for eligible new subscribers. Its length, the price charged when it ends and when that first charge happens are shown in the App and on Apple's purchase sheet before you start. Unless you cancel at least 24 hours before the trial ends, the subscription starts and your Apple Account is charged. You can cancel any time in iOS Settings → your name → Subscriptions. If you allow notifications, the App also reminds you the day before the trial ends; the end date Apple shows is the one that counts.

Lifetime purchase

The lifetime plan is a one-time payment for a non-consumable purchase. It does not renew and there is nothing to cancel. Buying lifetime does not by itself cancel a subscription you already have. Cancel that separately in Apple's subscription settings if you no longer want it.

What happens when access ends

If a subscription expires or you do not have an active plan, you can still stop a ringing alarm, switch existing alarms off and delete them. Safety is never behind the paywall. Recurring alarms you already set keep ringing until you turn them off. Adding or editing alarms needs an active plan.

Restoring purchases, refunds and withdrawal

  • Restore. If you reinstall NoNap or move to a new iPhone signed in with the same Apple Account, tap Restore Purchases on the plan screen or in Settings to recover your access. Purchases are tied to your Apple Account, not to a NoNap account, because there is none.
  • Refunds. Because Apple processes the payment, refund requests go to Apple, at reportaproblem.apple.com, under Apple's refund policy. We cannot issue App Store refunds ourselves.
  • EU and UK right of withdrawal. If you are a consumer in the EU or the UK, Apple's App Store terms explain how your 14-day right of withdrawal applies to in-app purchases and what happens if you ask for the content to be delivered immediately.
  • Family Sharing is not currently offered for NoNap purchases.

To verify that a purchase is active, the App uses the RevenueCat SDK, which receives your App Store purchase history. Section 6 of our Privacy Policy sets out exactly what is sent and why.

10Acceptable use

You agree not to:

  • Use the App in any way that breaks the law, or that harms, harasses or endangers anyone
  • Point the camera at another person during a wake task without their knowledge and consent
  • Interfere with, disrupt or attempt to gain unauthorised access to the App or any system it relies on
  • Introduce viruses, malware or other harmful code through or into the App
  • Use bots, scripts, emulators or modified builds to interact with the App, or tamper with wake-task verification
  • Circumvent the plan screen, purchase verification or restore flow, or use a fraudulent, refunded or shared purchase to obtain access you have not paid for

11Intellectual property

NoNap, including its software, source code, design, interface, artwork, sounds, copy, name and logo, belongs to Visana Studios or its licensors and is protected by copyright, trademark and other intellectual property laws. These Terms give you a licence to use the App, and nothing more. You get no ownership interest in it. All rights not expressly granted are reserved.

If you believe something in the App infringes your intellectual property rights, contact us at contact@nonap.app with enough detail to identify the work and the alleged infringement, and we will look into it.

12Prices and future changes

Prices are set per country in the App Store and shown in the App, in your local currency, before you buy. Section 9 explains free trials, renewals, cancellation and refunds.

We may change our plans, add or remove a plan, or change what a plan includes. A change never charges you for something you did not agree to: a new price for an existing subscription is announced by Apple in advance and, where the law requires it, only applies with your consent; a lifetime purchase stays valid for the App's features as they exist over time, though individual features may change as described in section 17.

13Disclaimers

The App is provided “as is” and “as available”. To the fullest extent permitted by applicable law, and without affecting your mandatory rights as a consumer, we make no warranties of any kind, express or implied, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose or non-infringement.

In particular, we do not warrant that:

  • The App will be uninterrupted, timely, secure or free of errors
  • An alarm will sound, trigger or wake you (see section 7)
  • Wake-task detection will count every repetition, object, step or metre correctly (see section 6)
  • Any statistic, streak, chart or insight the App shows is accurate or complete
  • The App will remain compatible with future versions of iOS or with your device

14Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect or consequential loss, loss of profit, loss of income, loss of data, or loss of opportunity arising from your use of the App, including any missed alarm, oversleeping or missed event, and including injury or property damage arising from physical wake tasks performed at your own risk under section 5.

Where our liability can lawfully be capped, our total liability to you for all claims relating to the App is limited to the greater of the amount you paid for the App through the App Store in the twelve months before the claim or EUR 100.

What we cannot and do not exclude

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intent or gross negligence, or for anything else that applicable law does not permit us to exclude. If you are a consumer in the EU or the UK, you keep every right your national consumer law gives you, and nothing here overrides it.

15Indemnity

To the extent permitted by applicable law, you agree to hold us harmless from claims, damages, losses and reasonable costs arising from your misuse of the App, your breach of these Terms, or your infringement of someone else's rights, including any claim brought by a third party in connection with a physical wake task you performed.

16Apple App Store terms

This section applies because you obtained NoNap through the Apple App Store, and it takes precedence over the rest of these Terms on the matters it covers.

  • These Terms are between you and us, not Apple. Apple Inc. (“Apple”) is not a party to them. We, not Apple, are solely responsible for NoNap and its content.
  • Scope of licence. The licence in section 3 is a non-transferable licence to use NoNap on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, including access by other accounts associated with you through Family Sharing.
  • Support. Apple has no obligation to provide any maintenance or support for NoNap. We provide support at contact@nonap.app, to the extent we choose to.
  • Warranty. Apple gives no warranty for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claim relating to a failure to conform to a warranty is our responsibility.
  • Claims. We, not Apple, are responsible for addressing any claim relating to the App, including product liability claims, claims that the App does not meet a legal or regulatory requirement, and claims under consumer protection or privacy law.
  • Intellectual property claims. If a third party claims the App infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
  • Export compliance. You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
  • Apple as third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17Changes to the app, and ending your use

We may add, change, suspend or discontinue any part of NoNap, and we may stop distributing or supporting the App altogether. Where a change materially reduces what the App does, we will give reasonable notice if we can. We are not liable for any change, suspension or discontinuation, other than as required by law.

You can stop using NoNap at any time by deleting it from your device. Since there is no account, that is all that is required. Sections 5, 11, 13, 14, 15, 18 and 19 continue to apply after you stop using the App.

18Governing law and disputes

These Terms are governed by the laws of Romania, and by applicable European Union law. If you are a consumer resident in another EU or EEA country, this choice of law does not deprive you of the protection of the mandatory consumer law of the country where you live.

If something goes wrong, please email contact@nonap.app before starting formal proceedings. Most problems are faster to fix directly, and we will make a genuine effort to resolve your complaint.

Courts and online dispute resolution

Disputes may be brought before the competent courts of Romania. If you are a consumer, you may also bring proceedings in the courts of the country where you live, and we will only sue you in those courts. Consumers in the EU may additionally use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr, or contact their national consumer protection authority (in Romania, the ANPC).

19General

  • Entire agreement. These Terms and our Privacy Policy are the whole agreement between you and us about the App.
  • Severability. If a provision is found unenforceable, the rest stays in force and the unenforceable part is applied as closely as the law allows to its original intent.
  • No waiver. If we do not enforce a provision straight away, we have not given up the right to enforce it later.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example if the App or the business behind it is sold, provided your rights under these Terms are not reduced.
  • Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
  • Language. These Terms are written in English. Any translation is provided for convenience, and the English version governs.
